'''The public comment period has ended on the No Match Supplemental Proposed Rule. Experts expect it will soon be put into effect. What does it mean for you?
When you submit employee pay information that has some problem with the social security number, the Social Security Administration will send back a "No Match" letter. Then the clock starts—you must notify that employee within 30 days that there is a problem. The employee then has just 63 days to fix the problem. If they do not, you must fire them, or face penalties.
Unfortunately, these letters don’t prove a person is a non-resident—a “No Match” could happen for any number of reasons. In fact, the SSA''''s Inspector General found that 70 percent of discrepancies that result in No Match letters belong to native-born Americans.
Nevertheless, you now have to deal with the burdens of proving compliance. How can you be sure you’ll pass scrutiny? In a 90-minute audio conference, immigration attorney David J. Hart will share his expertise to help you be in line with the No Match Rule. He’ll describe what the rule really means, and tell you the systems and procedures you should have in place when Immigrations and Customs Enforcement comes knocking on your door.
Learning Points or Questions to be Answered:- The No Match rules—what the language means, in plain English
- How to track and document your activities to show compliance to ICE and the SSA
- What you can, and can’t say to your employee when a No Match comes back on them
- I got a No Match on a new hire, and I can’t wait two months to have this position filled. Can I just cut them loose and staff the position with someone else?
- My star employee got a No Match two months ago, and they still haven’t resolved it. Can I make them an independent contractor while they fix it?
- Is it worth it to get the E-verify system?
